Dhani dinyatakan bersalah karena telah menyebarkan informasi yang menimbulkan kebencian dan permusuhan antar individu berdasarkan Suku Agama Ras dan Antar Golongan (SARA).
Dilansir Tribunnews.com dari Kompas.com pada Selasa (27/11/2018), pentolan band Dewa 19 itu dianggap telah melanggar Pasal 45A Ayat 2 junto Pasal 28 Ayat 2 Undang-undang No 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik junco Pasal 55 Ayat 1 KUHP.
Dhani yang mendengarkan tuntutan tersebut tidak bereaksi apa pun.
Hakim Ketua, Ratmoho kemudian menanyakan kepada Dhani dan kuasa hukumnya apakah akan mengajukan pleidoi (nota pembelaan) atau tidak.
"Dua minggu yang mulia (untuk mengajukan pleidoi)," ujar kuasa hukum Dhani, Hendarsam Marantoko.
Kuasa hukum Ahmad Dhani, telah mengajukan pledoi kepada Majelis Hakim dan sidangnya akan digelar 10 Desember 2018 mendatang.
Menurut Dhani, hukuman yang dibebankan pada dirinya tidak layak, karena jaksa tak menyebutkan secara gamblang golongan mana yang merasa jadi sasaran ujaran kebenciannya.
"Jadi jaksa tidak sebutkan kepada siapa saya beri pernyataan kebencian, kepada orang Cina kah, Arab kah, agama Islam kah, Kristen kah. Ngga ada," tegas Dhani usai sidang tuntutan di Pengadilan Negeri Jakarta Selatan, Senin (26/11/2018).
"Jadi SARA itu hanya berupa retorika (jaksa) saja tapi tidak ada detilnya," tambah Dhani.
Pentolan Grup band Dewa 19 ini mengistilahkan sasaran dugaan kebenciannya yang ditudingkan jaksa kepada Dhani adalah golongan abstrak alias tidak jelas.
"Golongan mana yang saya beri ujaran kebencian. Berarti abstrak," ujar Dhani
"Ada golongan yang abstrak, yang dituduhkan ke saya bahwa saya telah memberikan pernyataan kebencian kepada golongan yang abstrak itu,” tambah suami Mulan Jameela ini.
Dhani menilai, tuntutan yang dijatuhkan JPU kepada dirinya bersifat subyektif karena ada tekanan dari pihak lain.
Alasannya, Dhani menduga hukuman tersebut merupakan aksi balas dendam atas kasus Basuki Tjahaya Purnama alias Ahok yang saat ini sedang menjalani di penjara akibat ujaran kebencian, masalah yang sama dengan dirinya. (*)
